Man Denied Bail While Awaiting Retrial In Manners Shooting

A man awaiting his second trial for the murder of Jordan Manners was denied bail on Friday.

Lawyers for the accused, known only as J.W., asked for his release after the now 20-year-old’s first trial ended with a deadlocked jury in late March.

But Ontario Court Justice Ian Nordheimer rejected the request, arguing the public would lose confidence in the justice system if J.W. were released. Other reasons for the decision cannot be released because of a publication ban.

Manners, 15, was shot to death in May 2007 inside his high school, C.W. Jefferys Collegiate Institute.

Police arrested J.W. and C.D., another 20-year-old who cannot be named under the Youth Criminal Justice Act, and charged them with first-degree murder.

But during their trial, two of the Crown’s main witnesses recanted earlier statements that placed J.W. with Manners at the time of the shooting. The pair claimed they weren’t there after all and had only heard other students talking about it.

The retrial is scheduled for January 10, 2011. J.W. could face 10 years in jail if convicted and sentenced as a youth or life imprisonment if treated as an adult.
