Lawyer Testifies He Did Not Paw Girlfriend’s Naked Roommate

A 48-year-old defence lawyer testified on Wednesday he did not attempt to paw a woman two years ago, when she was living with his then-girlfriend.

At his sexual assault hearing, Calvin Barry, a Crown prosecutor for more than 16 years, admitted he was staying at the women’s condo on May 23, 2008 after an event.

The morning after, he claimed he was going to ask the victim for a ride downtown, but when he knocked on her bedroom door and pushed it open, he caught her naked and she screamed.

Barry testified he then apologized, turned his head and backed away from the door.

“She was embarrassed and scared that I saw her naked,” he said.

The 32-year-old victim described the incident from her perspective. She said at about 6:30am, she was washing her hair when Barry opened the shower door and tried to grope her.

She said when she screamed, Barry hushed her, but not before her roommate hauled him out of the bathroom.

The victim said her roommate promised Barry would not be returning to the condo. Nine days later, the court heard, he was back.

“Initially [the fact he was a lawyer] deterred me. I didn’t want any hype around the whole situation,” she said.

But his apparent return prompted her to contact police on June 11 and evict her roommate of three years.

Crown prosecutor E. Yereniuk remarked it was “almost like it was two different incidents.”
