Mom Convicted Of Killing Autistic Daughter Wins Appeal

A mother convicted of killing her autistic daughter was released from custody on Tuesday.

With her husband David Chen by her side, Xuan Linda Peng said she wanted to have another baby.

It was Chen who found the couple’s four-year-old daughter in the family bathtub in July 2004. Scarlett was held under water until she drowned. Peng was found guilty of second-degree murder and sentenced to ten years in jail in March 2008.

However, that trial was overturned and a new trial was ordered. On Tuesday, Peng pleaded guilty to manslaughter and was sentenced to time served plus one day. She will also be under probation for three years.

Peng had spent 30 months in pre-trial custody.

“I loved my Scarlett but hated the autism,” Peng said outside of court.

She also said that she planned to return to China.
