Alleged victim continues testimony in College Street Bar sex assault trial

The alleged victim of a gang sex assault at the College Street Bar in Little Italy began her fourth straight day of testimony on Wednesday.

She contends she was repeatedly raped by the bar’s owner, Gavin MacMillan, and manager, Enzo De Jesus Carrasco. Both men have pleaded not guilty to gang sexual assault, administering a stupefying drug and forcible confinement. Carrasco has also pleaded not guilty to two additional charges of sexual assault.

The victim was questioned by Carrasco’s defence attorney Uma Kancharla, who opened the day asking questions about two photos and a video that the alleged victim’s boyfriend found on her personal phone two weeks after the alleged gang sexual assault.

The court heard that the photos were taken inside College Street Bar during the night in question.

Previously, the alleged victim testified that she erased the photos and video to appease her boyfriend and then, in a panic, contacted police to notify them of the evidence.

She claims she gave police her phone because she “wanted to get them whatever they needed off my cloud.”

The defence argued that it was in fact her father that gave police the phone and that the alleged victim didn’t give police the password to access her cloud — where the photos may have been stored.

In addition, Carrasco’s lawyer suggested that the alleged victim wanted to have further sexual contact with him on the night in question, during which she believes she was drugged and raped for hours.

She claims Carrasco jumped in her taxi and took her to his place where he raped her again.

Carrasco’s lawyer argued that she told the defendant that she wanted to “get him off” and asked if he had a condom. The defence also suggested that the alleged victim was taking oxycodone recreationally before the reported assault. The complainant denied these accusations multiple times.

The central issue in question is whether the complainant consented to sexual acts and whether she had the capacity to consent.

The trial by jury continues Thursday.
