The only youth charged with murder in the 2005 Boxing Day shooting death of 15-year-old Jane Creba has been ordered to stand trial in the case.
Justice Bruce Young made the decision Thursday, prompting an angry outburst from the accused, who cannot be named under the Youth Criminal Justice Act. Now 19, he’ll be tried on one count of second-degree murder, six counts of attempted murder and nine firearms-related charges. Because he was 17 at the time of the shooting his identity is protected under the Youth Criminal Justice Act.
Creba was out shopping with her family in the Yonge and Dundas Sts. area when she was caught in the crossfire of what’s believed to be a shootout between rival gangs. Six others were injured by flying bullets.
The young man was arrested at a subway station shortly after the incident along with another suspect, 23-year-old Andre Thompson.
Ten people have been charged in the case. Tyshaun Barnett, 20, Louis Raphael Woodcock, 20, and Jeremiah Valentine, 25, also face charges of second-degree murder and attempted murder. Thompson, his brother Shaun Thompson, 22, Vincent Davis, 26, and Andrew Smith, 22, are charged with manslaughter. Two other youths are charged in the case, but with manslaughter, not murder.
The youth committed to stand trial is due back in court in late September. Preliminary hearings for the other suspects are taking place in the next couple of months.
