Defence Awaits Decision On Third Mendieta Trial

Erika Mendieta and her lawyer are waiting for a decision on her third trial for murder.

She’s accused of second-degree murder in the death of her daughter, Emmily Lucas. The two-year-old was killed in 2003.

The defence has requested that Mendieta be tried by judge alone.

Her first trial ended with a hung jury in 2009. Earlier this week, a judge declared a mistrial after the jury complained about an assistant Crown attorney’s strange behaviour.

Both jurors and Mendieta herself allege Paul Alexander, a co-counsel in Mendieta’s first trial, sat in the front row of the court and made strange and distracting faces.
