Class-action lawsuit filed over VIA derailment

TORONTO, Ont. – Two law firms have filed a class-action lawsuit on behalf of all passengers on the VIA Rail train that derailed in Burlington on Sunday.

The suit was filed by Toronto-based Charney Practice Group and Sutts, Strosberg of Windsor.

The lawsuit is seeking $10-million in compensation from VIA Rail and Canadian National Railway, for physical and emotional injuries, loss of income and medical expenses.

Lawyer Ted Charney said the passengers had a contract with VIA that guaranteed them safe passage.

The suit also alleges negligence on the part of both companies.

The Windsor company handled a successful class action in the 1999 VIA derailment in Thamesville in which two crew members died and 77 people were injured.
