A by-election has been confirmed for Ward 9 York Centre, several weeks after an Ontario Superior Court Justice declared last October’s results invalid due to voter list irregularities, largely in the form of absent electoral officials’ signatures.
The city had the option to appeal the judge’s ruling, but declined to do so.
The city clerk’s decision to call the by-election Friday sets up an intriguing re-match between incumbent councillor Maria Augimeri and challenger Gus Cusimano, who is endorsed by Mayor Rob Ford.
Voters in Ward 9 will go to the polls July 25th.
Augimeri won by just 89 votes in the Oct. 25 municipal election, with Cusimano a close second. The runner-up launched a civil lawsuit against the city after he became aware of the irregularities.
On his website, Cusimano said he moved forward with the legal action after, “many concerns and reports surfaced about serious irregularities and inconsistent voting procedures.”
“At least 455 people voted who may not have been legally able to, making them ineligible to vote,” he stated.
