No charges after fatal fall from Scarborough building: SIU

The province’s Special Investigations Unit will not lay charges against a Toronto police officer in the death of Pardeep Singh Mann, 31.

Mann fell 12 storeys to his death at 60 Town Centre Ct., near McCowan and Ellesmere roads, on Dec. 29, 2011.

The SIU said Wednesday two Toronto police officers went to the address looking for Mann.  He was wanted on two arrest warrants issued by Durham regional police.

As police in the hall were trying to talk to him through the door of a 21st-floor apartment, a neighbor told officers he was attempting to get onto their apartment balcony.

Police then entered the neighbour’s apartment, and one officer walked out onto the balcony. The officer said he saw Mann attempting to climb back to his own balcony, but Mann fell and landed on a ninth-floor balcony.

He was pronounced dead at the scene.

The SIU spoke to the officers, neighbours, and other witnesses, and also looked at closed circuit television of the incident in their investigation.

“In my view, the subject officer had no direct involvement in Mr. Mann’s demise,” SIU director Ian Scott said in a statement released Wednesday.

“The only reasonable conclusion to draw from the investigation is he slipped when attempting to return to his own balcony and fell to his death. The subject officer cannot be held criminally responsible for the regrettable result of Mr. Mann’s attempt to elude a lawful apprehension.”
