The preliminary hearing into the police shooting death of Sammy Yatim is over.
PC James Forcillo has been ordered to stand trial on second degree murder.
There is a publication ban on any evidence given by the civilians and officers who witnessed the fatal shooting of Yatim, including video of the 18-year-old who was holding a knife on a Dundas streetcar last July.
Ontario’s Special Investigation Unit recommended the charge on Aug. 19, 2013.
It is conceded by the defence that Forcillo intended to shoot Yatim. The test at trial will be, was he justified in doing so.
Forcillo is out on bail, and carrying out restrictive administrative duties with the TPS.
Forcillo will next attend superior court, July 30, to set a date for his trial, likely the fall of 2015.
