Milton man who fatally shot alleged home intruder has murder charge dropped

A man from Milton who fatally shot someone that allegedly broke into his home earlier this year has seen his murder charge withdrawn.
The second-degree murder charge against Ali Mian was dropped by the Crown during an appearance in a Milton courtroom on Monday morning, Mian’s lawyer confirmed.
Officers were called to a home on Gibson Crescent, in the early morning hours of Feb. 19. Police said a group of suspects entered the home with an “intent on committing a robbery” when they were confronted by a man inside before a number of shots were fired.
One suspect was pronounced dead at the scene. A second suspect was arrested and charged with breaking and entering and possessing an illegal firearm.
Police said Mian was also taken into police custody and charged with second-degree murder.
In a statement to CityNews, criminal lawyer Jag Virk confirmed Mian was his client and argued he should not be charged with murder for shooting “at an intruder that broke into his home and attacked his mother.”
“He is a registered firearm owner and used his gun legally against an armed intruder,” read the statement. “His intention was not to kill the intruder; he only shot at him once.”
Police said at the time the incident was isolated to the residence and appeared to be targeted.
It’s not immediately clear why the murder charge against Mian was dropped.
